Anthony L. Paccione

Anthony L. Paccione, co-head of the New York Litigation practice, concentrates in complex commercial, real estate and financial services litigation. He has extensive trial experience, including multi-week jury and non-jury appeals in both federal and state courts related to securities, banking and financial services-related matters.

Anthony represents a broad spectrum of clients, including hedge funds, banks (domestic and foreign), Fortune 500 companies, securities firms, futures commodity merchants and other major financial institutions. He handles suits involving Ponzi schemes, lender liability claims, securities fraud, international law issues and securities matters. Anthony represents companies, their investors and boards in Securities and Exchange Commission (SEC), New York Attorney General and Commodity Futures Trading Commission (CFTC) investigations and related civil lawsuits.

He teaches trial skills courses, lectures and publishes articles on various litigation topics. He is also a frequent lecturer on litigation and regulatory issues in the cryptocurrency, blockchain and digital ledger technology arenas. Anthony is active in arbitration and regularly serves as a mediator for the US District Court for the Southern District of New York.

  • Representation of the owners of Spring Creek Towers (formerly called Starrett City), the largest federally subsidized housing development in the country, in litigation seeking to prevent the $905 million sale of that complex.
  • Representation of a bank syndicate in a $500 million litigation involving Town Square Mall in Las Vegas. Prevailed all the way through appeals heard by the Supreme Court of the State of Nevada.
  • Representation of a lender against claims arising out of a failed resort/residential development involving loan default, conditions precedent to draw requests, fraud, fraudulent transfers, violation of transfer prohibitions and unjust enrichment.
  • Representation of the agent bank in connection with claims to recover losses on a loan made to finance a film distribution company.
  • Representation of construction loan lender in billion-dollar, multidistrict litigation relating to the Fontainebleau Las Vegas resort.
  • Representation of a Farm Credit Bank in defense of claims alleging wrongful redemption of $500 million subordinated notes.
  • Representation of multinational Dutch Trade Credit Insurance Company in NY State Court Commercial Part action asserting tort claims; successful dismissal of all claims before discovery and sustained on appeal to First Department.
  • Representation of private investment fund co-defendant against claims that it caused an unrelated hedge fund’s losses in BLMIS Ponzi scheme; all of the $2.9 billion claims were dismissed in Federal District Court and sustained on appeal by the US Court of Appeals for the Second Circuit.
  • Representation of a major financial institution in an action seeking to recover substantial losses caused when money market “broke the buck.”
  • Representation of numerous institutions, partnerships, hedge funds, investment managers and individuals in connection with highly publicized Ponzi schemes, including Madoff, West Gate and Stanford.
  • Representation of a futures commodities merchant in defending multimillion-dollar fraudulent conveyance claims.
  • Representation of several hedge funds in connection with SEC, New York Attorney General and CFTC investigations and related civil lawsuits arising from mutual fund market timing trading practices.
  • Representation of a public company and its senior management in a federal securities class action, related derivative cases and SEC investigation. Obtained dismissal of all class and derivative claims; appeal pending.
  • Representation of the defendants in a securities fraud action brought by investors in a hedge fund that invested in subprime automobile finance loans.
  • Representation of a trader in a FINRA investigation concerning credit default swaps.
  • Representation of the president of public utility company in shareholder derivative actions.
