Our Clients

Katten advises clients on electronic discovery and information governance matters across a variety of industries, including banking, insurance, health care, real estate, education, manufacturing and energy. We frequently assist clients involved in class action and other complex litigation, as well as civil and criminal government investigations, while navigating sophisticated e-discovery challenges both large and small in a streamlined, proportional and cost-effective manner. Katten lawyers also often serve as "e-discovery liaisons" in interacting with third-party forensic experts, corporate information technology departments, opposing litigants, government officials and the judiciary.

Our Services

Our Electronic Discovery and Information Governance team helps clients stay ahead of the curve with respect to developing law, best practices and emerging technologies. We assist clients in determining how best to preserve and maintain electronically stored information (ESI) and meet preservation and discovery obligations successfully and efficiently. As importantly, we provide valuable advice and counsel regarding cost-effective strategies and solutions for achieving and maintaining e-discovery preparedness, as well as developing and implementing robust and compliant records retention policies and practices.

Katten's e-savvy attorneys guide clients through the e-discovery process and help them devise and implement sound and defensible production plans that use an appropriate mix of internal and external resources and that avoid potentially costly missteps. Through innovative strategies and thoughtful use of best practices and technology, we empower clients to be more proactive and to better control the sometimes staggering costs associated with identifying, preserving, processing, reviewing and producing substantial volumes of ESI. Our clients also benefit from Katten's experience and relationships with numerous outside e-discovery service providers and forensic experts to provide any requisite technical assistance.

Experience
  • Lead e-discovery and evidence counsel to a major private polymer and fiber manufacturer in receipt of a federal grand jury subpoena issued in connection with the Resource Conservation and Recovery Act. ESI preservation efforts included comprehensive data mapping, on-location custodial interviews, ad hoc consulting on potential data corruption and archiving concerns, and the hosting of an electronic workroom.
  • Representation of a Fortune 10 energy provider as lead e-discovery and evidence counsel in responding to civil, criminal and administrative actions arising under federal, state and local air quality and worker safety laws and regulations. Negotiated evidence and site control agreement and managed response to more than 700 information requests and demands issued by various government entities.
  • Lead e-discovery and evidence counsel to a leading lawn and garden manufacturer in the largest federal enforcement action in the history of the Federal Insecticide, Fungicide, and Rodenticide Act.
  • Representation of one of the largest independent midstream energy companies in North America as lead e-discovery and evidence counsel in responding to federal investigations arising out of the Clean Water Act, worker safety laws and environmental laws governing hydraulic fracturing.
  • Representation of a Fortune 10 energy provider as lead e-discovery and evidence counsel in responding to federal and state parallel proceedings arising under the Clean Air Act. Assisted in the design and implementation of a "rapid response" initiative to identify, preserve, collect and produce ESI responsive to federal and state information requests.
