40 Years of FCPA: A View From the Monitorship Trenches

Leading up to the 40th anniversary of the Foreign Corrupt Practices Act on December 19, Gil Soffer, managing partner of the Chicago office and national co-chair of the firm's Litigation practice, authored an article entitled, "40 Years of FCPA: A View From the Monitorship Trenches" for Law360's Expert Analysis Series. The article focuses on the corporate monitorship process and how to prepare for a job that has few parallels in the legal industry. Gil states that while "the task of a white collar criminal lawyer is usually straightforward," none of the usual skills can fully prepare a corporate monitor for the most unusual feature of the job: That the monitor does not represent anyone. The article also provides key lessons learned by one monitor and his team over the course of an FCPA monitorship still in progress.
