Zia Modabber Comments on His Successful Representation of Nick Clainos, Executor of Bill Graham Estate

Firm News | October 20, 2015

Zia Modabber, head of the Los Angeles Litigation and Dispute Resolution practice, is quoted in the San Francisco Chronicle and Pollstar regarding a federal judge's recent dismissal of a lawsuit filed by the sons of the late Bill Graham against Zia's client, executor and former Bill Graham Presents (BGP) president Nick Clainos. The original suit in 2010 accused Zia's client of breach of fiduciary duty, fraud, conversion and copyright claims. A district judge dismissed that suit in 2011, but an appeals court reinstated the suit in 2013. Last week, the trial judge granted summary judgment for Nick Clainos, ruling that the memorabilia in question was actually owned by BGP and sold as part of an above-board transaction, and that the Fillmore trademark was part of the company sale. "I hope that [sons] Alexander and David move on with their lives and get rid of their misguided fears that somebody wronged them," Zia Modabber said.("Judge Dismisses Graham Estate Suit," October 13, 2015; "Judge Dismisses Suit by Bill Graham’s Sons Over Inheritance," October 12, 2015).
