Katten's Environmental and Workplace Safety team represents major companies in a wide range of industry sectors, including oil, energy, chemicals, biofuels, maritime and other transportation, manufacturing, and construction, on the full range of health and safety issues that they face.

Our Services

Katten attorneys are at the forefront of emerging process safety issues. Our attorneys work closely with clients to equip them to respond to the increasing focus on process safety in the context of industrial safety ordinances and requirements for inherently safer systems at the local permitting level.

We also advise clients on high value concerns involving federal and state laws regulating health and safety obligations. We provide counsel on all aspects of the Occupational Safety and Health Administration's (OSHA) safety standards, including process safety management, hazard communication, hazardous waste operations and emergency response, and lockout/tagout.

We represent clients in connection with regulatory inspections and enforcement actions and advocate their interests in administrative hearings on alleged violations and subsequent appeals. Katten attorneys help clients appeal citations and negotiate settlements. We are one of the national leaders in the refining and chemical manufacturing industries involving inspections and enforcement resulting from OSHA's Regional Emphasis Program (REP) and National Emphasis Programs (NEP) for process safety management (PSM) and the US Environmental Protection Agency's (EPA) Risk Management Plan (RMP) program. Our Environmental and Workplace Safety team represents clients in investigations into workplace fatalities, accidents and other safety incidents.

Our team previously served as staff to the BP US Refineries Independent Safety Review Panel that assessed issues of safety performance, culture and oversight in the wake of the Texas City Refinery disaster. We bring this experience to bear in assisting clients in evaluating their safety performance and systems for environmental, health and safety as part of their efforts to avoid similar incidents and develop a safety culture.

Our attorneys help clients take the lessons learned from previous major incidents and apply them proactively to their operations. This includes advising boards of directors and executive management on their role in maintaining oversight of regulatory performance, safety culture improvement and how to strengthen the effectiveness of compliance programs. We also represent clients in investigations in response to whistleblower complaints and other alleged violations.

  • Representation of a chemical manufacturer into a fire that seriously injured two employees and resulted in investigations by OSHA and the EPA.
  • Advocacy and provision of advice on EPA and OSHA proposed rulemaking regarding RMP and PSM regulations.
  • Provision of advice to a natural gas company and pipeline companies regarding compliance with safety regulations for gas-gathering equipment.
  • Representation of a national utility company in connection with the implementation of a process safety management program.
  • Representation of a vehicle manufacturer in connection with an OSHA inspection into machine guarding and other workplace safety standards, including subsequent enforcement.
  • Representation of integrated energy companies and industry groups in multiple process safety and environmental regulatory rulemakings by federal and state agencies.
  • Representation of multiple oil refineries, chemical plants, and midstream oil and gas companies in defense of OSHA citations alleging violations of process safety management standard and other safety regulations.
  • Representation of multiple refineries and industrial manufacturing plants during planned OSHA inspections, including Refinery NEP inspections.
  • Defense of clients in four OSHA inspections involving crane accidents or failures, and assistance with defending related civil litigation.
  • Representation of a Fortune 50 integrated energy company in an investigation by BSEE and United States Coast Guard (USCG) into an offshore contractor fatality.
  • Provision of advice to a major electric utility in connection with the development and implementation of process safety management systems related to a multibillion-dollar capital project.
  • Representation of a Fortune 50 integrated energy company with respect to a loss of well control resulting in a contractor fatality and investigations by OSHA and other enforcement agencies.
