Article provides best practices for risk managers and health providers to help them make the strongest case against attempts to discover and access incident reports. Based on the Appellate Court of Illinois's ruling on Daley v. Teruel and other key cases, the article highlights the following actions:
- develop a specific and broadly worded Patient Safety Evaluation System (PSES) Policy;
- use supporting detailed affidavits; and
- carefully describe your PSWP pathway.
