Three Katten attorneys will participate in the Texas Health Law Conference on Sunday, October 7 to Tuesday, October 9. White Collar, Investigations and Compliance partner Brandon McCarthy and associate Ryan Meyer will participate in "The Largest Healthcare Enforcement Action in U.S. History: Why it Happened and How to Avoid Being a Part of the Next One" panel discussion at 1:00 p.m. on Monday, October 8. Panelists will discuss the national health care "takedowns" carried out by the Department of Justice (DOJ) and the Department of Health and Human Services since the formation of the Health Care Fraud Prevention & Enforcement Action Team in 2009, which target a variety of criminal activities affecting the healthcare industry. While the focus of the takedowns have shifted somewhat between administrations, healthcare fraud enforcement remains a significant priority. They will discuss the factors that have influenced DOJ's increasing focus on civil and criminal enforcement from both sides: a federal prosecutor and healthcare fraud defense counsel. They will also address the key issues at the forefront of enforcement from their perspectives and the various considerations at issue for providers facing potential government enforcement actions.

Health Care partner Kenya Woodruff will participate in the "Civil Enforcement Update" panel at 9:45 a.m. on Tuesday, October 9. The session will address recent cases, fines, settlements and other trends in civil healthcare enforcement actions and will include both Federal and state enforcement activity. Common claims, defenses and issues related to extrapolation and the calculation of damages will also be explored.
