Litigation and Dispute Resolution partner Scott Morrison is quoted in this article on Lord & Taylor's efforts to interfere with the redevelopment of the White Flint Mall from an enclosed mall into a town center. An appellate court recently affirmed the trial court's summary judgment ruling denying Lord & Taylor's request for a permanent injunction to block the redevelopment. The mall's owner, however, argues that the department store's damages portion of the lawsuit is still making it impossible for the mall to proceed with the project. Scott notes that "Given the real-world impact the litigation is having on the redevelopment, drawing out the litigation gives Lord & Taylor the very relief – an injunction – that this court and the Fourth Circuit have denied it."
