Overview

Robert Ayers represents clients in inspections and enforcement actions brought by government agencies relating to environmental, health and safety matters. He provides emergency response services following industrial incidents and conducts privileged investigations on his clients’ behalves. Robert also litigates regulatory enforcement cases brought by various government agencies, including the Occupational Safety and Health Administration (OSHA) and the Bureau of Safety and Environmental Enforcement (BSEE).

Robert has a wide range of litigation experience. He has represented clients in environmental, commercial and intellectual property cases in federal and state courts across the United States in disputes relating to oil and gas development, groundwater contamination, personal injury, breach of contract, patent infringement, and misappropriation of trade secrets.

  • Representation of an oil and gas company in state court where plaintiffs claimed that the release of hydrocarbons and other chemicals from the blowout of a nearby well damaged their property.
  • Representation of a refining and petrochemical company in state court where the State of Vermont claimed MTBE products contaminated the state's waters.
  • Representation of an oil and gas company in federal court where plaintiffs claimed that the defendant's oil and gas operations contaminated their groundwater and exposed them to chemicals resulting in personal injury.
  • Representation of a global energy company in connection with an explosion at a refining facility that resulted in federal and state regulatory agency investigations.
  • Representation of a Fortune 50 chemical manufacturer in connection with investigations and enforcement actions by various government agencies—including the CSB, OSHA and EPA—into a four-fatality accident resulting from the release of toxic chemicals.
  • Representation of multinational automotive manufacturer in enterprise-wide compliance assurance and safety review.
  • Representation of an oilfield services company in connection with an inspection and enforcement action brought by OSHA following a fatality at an oil and gas site.
  • Representation of an oilfield services company in connection with a lockout/tagout citation issued by OSHA following a significant injury at an oil and gas facility; obtained a settlement from OSHA that withdrew the citation.
  • Representation of an oil and gas company with regards to an OSHA enforcement action for an alleged PSM violation at its Texas refinery; obtained a favorable settlement.
  • Representation of a global energy company before the Interior Board of Land Appeals relating to an Incident of Noncompliance issued by the BSEE.
  • Representation of an oil and gas company in state court where plaintiffs claimed they suffered personal injuries resulting from alleged exposure to toxic chemicals while working at an oil and gas site.
  • Representation of an oil and gas company in federal court where plaintiffs claimed defendant's oil and gas operations contaminated their groundwater and exposed them to various chemicals resulting in personal injury.
  • Representation of a chemical distribution company in connection with an incident response following a fatality at its facility.
