RMP Reconsideration Rule Proposes Deregulation in Response to Stakeholder Concerns

The U.S. Environmental Protection Agency ("EPA" or "agency") recently released its Proposed Risk Management Plan ("RMP") Reconsideration Rule ("Reconsideration Rule") which, if finalized, would rescind or modify many of the final RMP Amendments issued last year under the Obama Administration. Implementation of the RMP Amendments was delayed by the current administration to allow EPA time to consider petitions for reconsideration submitted by three sets of stakeholders ("Petitioners"), including a joint petition filed by eleven states.
