Stacey McKee Knight, a partner in the Litigation and Dispute Resolution practice, spoke with Daily Journal regarding misclassification lawsuits in the trucking industry. Short-haul companies often classify drivers as independent contractors, who are paid piece-rate. Many truck drivers have filed private suits against drayage companies for unpaid wages, claiming they were misclassified and were, in fact, regular employees, who should have received hourly pay, overtime and rest breaks. Stacey, who defends companies against misclassification suits, counters that the drivers want to keep their independent contractor status as they’re essentially running their own businesses.
