Mark Farley Discusses Recent Environmental Accidents on Houston Public Media Radio Program

Mark Farley, head of Katten's Workplace Safety practice and co-head of the Environmental practice, discussed the increase in criminal charges against companies over environmental accidents. He suggested that the frequency of high-profile accidents may not be changing as much as the public perception and awareness of them. He noted that individuals and organizations can now face criminal liability for simple negligence. Mark said that a downside of the increasing criminalization of major incidents is that "people who have key information that would be part of learning what went wrong and what needs to be done in the future to prevent it from happening again are going to become reluctant to cooperate with investigation teams."
