This article examines privacy issues and legal boundaries surrounding the use of social media in investigations. In light of recent legal rulings and changing technology, the article provides best practices to help companies navigate the myriad of state and federal laws governing privacy, access and ethical issues related to the use of social media by employers. An important takeaway for companies is to be transparent about employees' privacy rights when it comes to social media and personal device policies.
