Katten Secures Motion to Dismiss for YCharts in California District Court Case

Firm News | May 19, 2015

As panel counsel for AIG on their Technology/Media Panel, Katten attorneys secured dismissal of a case filed by a party against YCharts, an AIG-insured company, in a California district court. In the case, Katten's client received financial data from a reputable company, but the data was incorrect. An investor relying on the data experienced financial losses as a result. However, the terms of use he agreed to disclaimed any liability based on the inaccurate data. The court denied a request to amend the complaint as the defects cannot be cured.

Floyd Mandell, national co-chair of Katten's Intellectual Property group and co-head of the Trademarks and Trademark Litigation practice, led the team, which included Intellectual Property special counsel Carolyn Passen and associate Eugene Endress. Litigation and Dispute Resolution partner Joel Weiner and associate Meegan Maczek served as local counsel in Los Angeles.
