Katten Obtains Dismissal for Relativity Media in Defamation Suit

A New Jersey federal judge has dismissed a defamation suit against Relativity Media LLC and other producers of the film Out of the Furnace. Plaintiffs—members of a Native American ethnic group—alleged the film portrayed them in a negative light.  Judge William H. Walls dismissed the case, ruling that the movie, a purely fictional film, did not portray any specific individual plaintiffs or make any factual assertions about them, and, thus, plaintiffs could not meet the "of and concerning" requirement for stating a claim.  Partner Joel Weiner represented Relativity Media in the case.
