Katten Obtains Dismissal for Cumulus Broadcasting in Defamation Suit

A Cook County circuit court judge has dismissed a defamation suit brought against Katten client Cumulus Broadcasting, LLC, as well as co-defendants Fox News and the Chicago Sun-Times. Plaintiff, a professor at Northwestern University, alleged defamation and false light based on the publication of an article title. Fox and Cumulus received the text via the Chicago Sun-Times wire service and republished the article verbatim. Judge Kathy M. Flanagan ruled that all complaints against defendants failed due to a lack of per se defamation, and granted the defendants' motions to dismiss, with prejudice, with no leave to amend. Intellectual Property attorneys Floyd Mandell, Carolyn Passen and Eugene Endress represented Cumulus in this lawsuit.
