Overview

Harold Levy focuses his practice on transactional and regulatory matters involving the development and management of multifamily affordable housing projects insured or assisted by the US Department of Housing and Urban Development (HUD) under the Federal Housing Administration (FHA) and Section 8 programs. His experience includes low-income housing tax credit and bond-financed multifamily housing developments. Harold represents a variety of clients, including developers, mortgage bankers, investments firms, and other financial institutions and principals involved in the development and financing of affordable rental housing projects.

Harold has represented a housing finance agency in bond refunding of projects with HUD assistance and mortgage bankers in loan closings, and addressed Multifamily Accelerated Processing (MAP) compliance issues and FHA mortgage insurance claims. He has represented developers in the renewal of expiring Section 8 contracts under the mark-up-to-market (MUTM) program, refinancing of Section 202 elderly projects, equity take-out and rehabilitation financing, workouts of defaulted HUD mortgages, HUD property dispositions and mortgage sales, compliance and enforcement matters, financing low-income apartment projects with tax-exempt bonds, closing Fannie Mae refinancing loans, obtaining HUD transfer of physical assets (TPA) approval, and converting projects from participation in HUD/Mitchell-Lama programs to market-rate developments.

Harold previously served as chief attorney in the Loan Management and Property Disposition Section of HUD’s Office of General Counsel. His responsibilities included loan servicing, prepayment and preservation issues, property disposition and mortgage sales.
