Gregory Dillard (Greg), managing partner of the Houston office, advises clients on health and safety (EHS) issues, and focuses on major accident response, including upstream, midstream and downstream process safety management (PSM) incidents and workplace fatalities. Greg provides on-site response support after such incidents and litigates subsequent regulatory enforcement cases, including Occupational Safety and Health Administration (OSHA), Bureau of Safety and Environmental Enforcement (BSEE) and state agencies. Greg also routinely supervises internal company investigations and advises and trains companies on all aspects of safety and health compliance law to help prevent incidents.

Greg has a wide range of litigation experience, having represented clients before administrative law judges in both state and federal courts. He tried a 20-day OSHA trial, resulting in a dismissal of all 42 willful citations and a decrease in penalties from $2.9 million to $35,000. Greg’s experience with workplace and process safety allows him to meet the critical needs of clients from the onset of an incident through trial.

Greg is co-chair of Katten’s Process Safety Advocacy group, which focuses exclusively on effective advocacy for oil, gas and chemical companies related to the proposed revisions to the PSM rules under the Occupational Safety and Health (OSH) Act. As co-chair, Greg works to influence OSHA as it continues its efforts to reform the current PSM standard, including development of strategy, meeting with regulators and drafting comments to OSHA.

Major Accident and Incident Response
  • Representation of multiple facilities after a major accident and fatality, including response to OSHA inspection, assistance in simultaneous response to CSB and EPA inspections, and assistance in defense of personal injury and property damage lawsuits.
  • Representation of multiple energy companies when they experienced uncontrolled releases from production wells.
  • Representation of an offshore production company after a rig explosion and fire in response to BSEE civil and criminal investigation, and assistance with defense of related civil litigation.
  • Representation of a pipeline operator after a fatality and after an incident involving destruction of neighboring private property.
  • Representation of a steel manufacturer during OSHA inspection of an employee fatality.
  • Representation of an amusement park facility after an employee fatality, including defense against OSHA citations and assistance with civil litigation defense.
OSHA, Safety and Health Litigation and Compliance
  • Provision of advice to a natural gas company and pipeline companies regarding compliance with safety regulations for gas-gathering equipment.
  • Representation of multiple oil refineries, chemical plants, and midstream oil and gas companies in defense of OSHA citations alleging violations of process safety management standard and other safety regulations.
  • Defense of clients in four OSHA inspections involving crane accidents or failures, and assistance with defending related civil litigation.
  • Representation of multiple refineries and industrial manufacturing plants during planned OSHA inspections, including Refinery NEP inspections.
Whistleblower and Employment Litigation
  • Lead internal investigation for a midstream company regarding DOT whistleblower allegations.
  • Representation of a pipeline company in DOT and STAA whistleblower litigation; obtained favorable settlement.
  • Representation of a steel manufacturer in OSHA investigation of 11(c) whistleblower allegations.
  • Representation of a concrete manufacturer in Texas in whistleblower litigation; successfully obtained summary judgment in favor of client.
  • Representation of an oilfield services company in Texas and Louisiana in a lawsuit opposing restrictive covenants and unfair competition; obtained a favorable settlement.
  • Representation of an oilfield services company in North Dakota in an ERISA lawsuit involving denial of benefits and settlement of a second ERISA suit.
  • Representation of an employer in a three-day arbitration of a breach of contract dispute with its employment systems vendor.
  • Representation of a manufacturer against unfair labor practice claims and arbitration of a collective bargaining grievance on behalf of the manufacturer.
