Greg Dillard Weighs in on Potential Changes to OSHA Refinery Inspections

Houston Managing Partner Greg Dillard was quoted by Bloomberg Environment on the Occupational Safety and Health Administration's (OSHA) national emphasis program covering fuel refineries and chemical plants and how OSHA will interpret its process safety management regulations going forward. Following the Occupational Safety and Health Review Commission's final order that overturned almost all of OSHA's originally proposed fine and citations for a major refinery's alleged violations, Greg noted that the Commission affirmed a key element of the regulations: "the employer's discretion." He stated, "The refinery can select which practices it wants to follow and implement them. OSHA is going to have to look at how companies have selected their practices and put them to use rather than specifying which practices the plant was required to follow."
