Floyd Mandell Provides Tips on Avoiding Intellectual Property Litigation Landmines

Floyd Mandell, national co-chair of Katten's Intellectual Property department and co-head of the Trademarks and Trademark Litigation practice, provides tips on avoiding problems in trademark litigation. For example, he suggests that an attorney defending a client should explore insurance coverage early. He also recommends acting as civil and professional as possible to opposing counsel, and he suggests, "Never use a mediator that you or someone you trust has not used, and do not wait until the close of discovery or worse yet, the eve of trial, to explore mediation."
