EPA Announces Changes to National Enforcement Initiative Program

The U.S. Environmental Protection Agency ("EPA") issued a policy memorandum on August 21, 2018 that announces changes to the national Enforcement Initiatives ("NEI") program. Memorandum from Susan Parker Bodine, Assistant Administrator, to Regional Administrators, Transition from National Enforcement Initiatives to National Compliance Initiatives (Aug. 21, 2018) ("Memo"). The Memo announces EPA's intention to evolve the NEI program into the National Compliance Initiatives ("NCI") program "by providing states and tribes with additional opportunities for meaningful engagement, by developing and applying a broader set of compliance assurance tools, and by aligning the NCIs with the Agency Strategic Plan measures and priorities." Importantly, the agency announced that Reducing Risks of Accidental Releases at Industrial and Chemical Facilities will remain a priority.
