Doron Goldstein Quoted on Data Breach Litigation

Doron Goldstein, co-head of Katten's Privacy, Data and Cybersecurity practice, was quoted in Law360 on data security measures companies can take to mitigate litigation risk in the event of a security breach. Doron notes, "The more you do to be prepared, the more likely it is that you will have a defensible position. Conversely, the less you do, the more exposure you will face." He adds that having robust security measures in place can mitigate claims for negligence. Doron states, "To some degree, the defenses against litigation claims and things that allow minimization of damages are a lot of the same things that help you to reduce the likelihood of those events happening in the first place and then to mitigate the actual damages they cause." Having the right, customized security plan is critical. "Merely having these policies in place isn’t necessarily enough. . . . A large part of an information security policy and response plan is whether it works for your company: whether you have the right people in place to perform it, whether you have the contact, whether your people understand and are able to understand what their roles are."
