DOL Hosts Small Business Roundtable Regarding Fair Pay and Safe Workplaces Rule and Guidance

The Department of Labor ("DOL") recently hosted a Small Business Labor Safety Roundtable to discuss the new Fair Pay and Safe Workplaces Federal Acquisition Regulatory Council contracting regulation and the accompanying DOL guidance. These materials were issued in response to President Obama's July 31, 2014 Executive Order 13673: Fair Pay and Safe Workplaces. EO 13673 directs agencies to develop requirements for contractors to "disclose labor law decisions" relating to violations of 14 federal labor and employment laws (such as the Occupational Safety and Health Act) and their state law equivalents when bidding on contracts worth more than $500,000. Contracting agencies will evaluate the information contractors disclose as a part of the determination of contractor "responsibility," i.e. whether the contractor has a satisfactory record of integrity and business ethics, that contracting officers presently must undertake before awarding a Federal contract.
