ABA Standards for Criminal Justice: Prosecutorial Investigations

Published by the American Bar Association Criminal Justice Section
Book | July 2014

In July 2014, the ABA published a paperback edition of the Standards on Prosecutorial Investigations (adopted by the ABA in 2008). This is the first time that the ABA has issued standards specifically focused solely on the role of prosecutors during the investigative phase of a criminal case. These new standards cover all aspects of criminal investigations, including the everyday work of prosecutors with police and other law enforcement agents; issues related to victims, witnesses and targets, confidential informants and cooperating individuals, parallel investigations, the use of subpoenas, search warrants and electronic surveillance, and also addresses the prosecutor's role in resolving investigation problems related to law enforcement and judicial misconduct, illegally obtained evidence, and responses to political pressure during the conduct of a criminal investigation. The ABA's Criminal Justice Standards provide guidance to practitioners and policy makers in the criminal justice arena. For the past twelve years, Steve Solow has served as the Reporter to the Prosecutorial Investigations Task Force. This book includes the blackletter standards as well as the detailed commentary that Steve prepared that was approved by the Standards Committee.
