Stock options backdating cases are changing the way securities litigation is handled. The first half of 2008 saw a wave of settlements. But courts and litigants have become more sophisticated and special litigation committees are playing an increasingly pivotal role. In addition, courts are now dealing with the practical impacts of Supreme Court decisions and judges are asking hard questions about topics like loss causation, scienter, and have even overturned jury verdicts.
