Michael Callahan, a partner in the Health Care Practice, is quoted in an article in Credentialing & Peer Review Legal Insider about how to maintain protection of hospital peer review information. The article, "Meeting the Burden of Proof for Peer Review Protection," addresses ways to avoid confidentiality challenges in light of recent decisions allowing peer review documents to be discovered. Mr. Callahan notes, "I think people lose sight of how they are managing the information and if they are doing it in a way to maximize these confidentiality protections." He suggests best practices such as keeping sensitive documents within the peer review committee and out of the credentialing file, introducing quality metrics, and adjusting policies and bylaws to align with state statutes.
