Mark C. Simon

Chicago Office

Mark C. Simon represents real estate investors, lending institutions, pension fund advisors and development companies on real estate finance and investment transactions. His everyday practice consists of representing lenders and borrowers on a wide variety of real estate loans and documenting joint ventures and property acquisitions and dispositions. In 30 years in practice, he has assisted clients in successfully resolving a wide array of complicated problems concerning shopping centers, hotels, condominiums, office buildings, apartments, and senior living, student housing and industrial properties.

In his pro bono work, Mark represents several small nonprofit organizations in their efforts to improve Chicago’s neighborhoods and is a board member of the Chicago Lawyers' Committee for Civil Rights Under Law. He is a frequent speaker on real estate finance and investment topics.

  • Representation of construction lenders on $288 million financing of 50-story condominium tower in Sunny Isles Beach, Florida.
  • Representation of private equity investor on financing of movie studio in Los Angeles.
  • Representation of agent on $5 billion unsecured credit line to publicly traded mall REIT.
  • Representation of fund advisor in forming new company to acquire and develop approximately 80 build to suit warehouse properties nationwide and negotiation of $100 million credit line.
  • Representation of a 13-lender syndicate in providing a $650 million secured corporate revolving credit facility.
  • Borrower's counsel on two single-asset CMBS financings in excess of $1 billion secured by Manhattan office properties.
  • Lender's counsel on the portfolio financing of 14 hotels in Ohio, Virginia and Arizona.
  • Representation of real estate core and opportunity funds on joint ventures and construction financings of multifamily, condominium and senior living projects across the country.
  • Representation of developer of 33- and 40-story apartment towers under construction in Chicago's River North neighborhood.
