Overview

Mark T. Ciani works on a variety of litigation matters, including shareholder class action and derivative suits, state and federal regulatory inquiries, False Claims Act matters, white collar cases, internal investigations, real estate disputes, Ponzi scheme litigation and general commercial litigation. He represents a broad spectrum of clients, including hospital operators, public and private companies and their senior officers, high net-worth families, entrepreneurs, investors, hedge funds, and banks. Mark has extensive experience in jury and non-jury trials.

In addition, Mark counsels companies on antitrust issues. Those matters involve a range of issues concerning price fixing, market allocation, group boycotts and other horizontal restraints; monopolization, intellectual property licensing and other intellectual property issues; industry-wide standard setting efforts; vertical restraints; distribution issues; and Robinson-Patman Act problems.

Mark also maintains an active pro bono practice, defending gun control laws against Second Amendment constitutional challenges. As part of this practice, Mark has submitted briefs to the Second, Fourth, Seventh, Ninth and Tenth Circuit Courts of Appeals, as well as numerous federal district courts and state courts.

  • Representation of numerous institutions, partnerships, hedge funds, investment managers and individuals in connection with highly publicized Ponzi schemes, including Madoff.
  • Representation of an operator of public hospitals accused of submitting false claims for Medicare and Medicaid reimbursement.
  • Representation of an insurance company against allegations of accounting fraud and bid rigging.
  • Representation of a medical supply manufacturer in an antitrust class action alleging monopolization and exclusive dealing.
  • Representation of corporate directors against allegations of breach of fiduciary duties arising from sale of the company.
  • Representation of trading and sales personnel of several financial institutions in DOJ, CFTC and SEC investigations of the FX markets.
  • Representation of an investment advisor in connection with criminal insider-trading charges in the US District Court for the Southern District of New York.
