This article explains that the key aspect of physician privilege restrictions is how they are defined in the medical staff bylaws and whether any form of restriction will entitle a physician to a fair hearing and appeal. Medical staff bylaws can make this clear by defining what is and is not a restriction as well as specifying who has the authority to impose them.
