Joel Weiner, a partner in the Litigation and Dispute Resolution practice, is quoted in a Law360 article regarding the copyright suit over horror film The Unborn. Claiming that Relativity Media LLC unit Rogue Pictures stole the movie’s plot from his unfilmed script, author Daniel Segal initially filed suit in 2010. The district court tossed the key claims in August 2011, and the US Court of Appeals for the Ninth Circuit affirmed the ruling that same year, stating that the two works did not rise to substantial similarity despite the fact that they both feature sets of twins and the idea of a haunting. On February 20, the Ninth Circuit refused Segal’s request that the court rehear Segal’s appeal en banc. Joel, who represented Rogue together with Gail Migdal Title and Gloria Franke, said the client is pleased and that “the ruling should put an end to this meritless and misguided lawsuit.” (“9th Circ.
