The US Court of Appeals for the Second Circuit affirmed the dismissal of a copyright infringement suit brought against NBCUniversal Media, LLC and production company Reveille LLC regarding NBC’s reality television series The Biggest Loser. The plaintiff sued NBC and Reveille in 2007, alleging that they had copied her outline for a weight loss competition show. After the US District Court for the Southern District of New York dismissed the case in 2006, the plaintiff appealed, alleging that the district court had erred and that she had insufficient time for discovery. The Second Circuit rejected the plaintiff’s arguments and upheld the district court’s ruling. Litigators Joel Weiner, Alan Friedman and Gail Migdal Title represented NBC and Reveille.
