Yoni Rosenzweig's practice focuses on complex business litigation including antitrust cases, intellectual property and technology matters, and general commercial disputes. Mr. Rosenzweig has represented clients in cases involving, among other things, claims of antitrust violations, copyright infringement, breach of contract and partnership disputes.
Mr. Rosenzweig's practice has spanned several industries, with a focus on financial services, entertainment, computer technology and the internet. He has experience in trials, arbitrations and dispositive motion practice.
Mr. Rosenzweig has represented many clients in connection with claims of price fixing, predatory pricing and other anticompetitive conduct under federal and California antitrust laws. His accomplishments in antitrust matters include:
- Representing plaintiff in a claim for unlawful conspiracy under the California Cartwright Act, Mr. Rosenzweig defeated a motion to dismiss the Cartwright Act claims and related claims brought by one of the nation's largest insurance companies.
- Representing computer manufacturer defendants, defeated class certification of a putative price fixing class action under Sherman Act section 1 for alleged price fixing of computer memory chips.
- As an integral member of the trial team, pursued a Sherman Act section 2 claim in federal district court in San Jose, California. Plaintiffs claimed that defendant engaged in unlawful monopolization by setting a "patent trap" at a standard setting body to capture an industry standard for computer memory technology.
Outside the antitrust arena, Mr. Rosenzweig's accomplishments include the following:
- Representing film distribution companies as plaintiffs suing a production company for breach of several contracts, Mr. Rosenzweig, prevailed on a motion for summary judgment and obtained a $6.2 million judgment on behalf of his clients in federal court (Alliance Atlantis Releasing Limited et al. v. Bob Yari Productions, 2010 WL 1525687).
- In a commercial dispute representing a high net worth defendant against claims that his company stole ideas from a former employee, Mr. Rosenzweig prevailed on a motion for summary judgment and dismissed his client entirely from the $15 million+ claim.
- On behalf of a large commercial bank, Mr. Rosenzweig successfully dismissed a cross-complaint at the pleading stage with prejudice. In that case, an investment banker claimed that Mr. Rosenzweig's client, the multinational bank, caused $10 million in damages by supposedly giving a "negative reference" to a prospective investor of the investment bank. The court dismissed the complaint without leave to amend.
- Second-chaired arbitration successfully defending a film completion guarantor accused of defaulting on a guarantee of a film by Spike Lee. Obtained an award of attorneys' fees against the claimant.
- Obtained jurisdictional dismissal at pleading stage of claims against Internet company for defamation based on web postings.
- Obtained dismissal by anti-SLAPP motion of defamation complaint filed by an American university (funded by a Japanese political party) against a Japanese publisher for defamation against the university.
Prior to joining Katten, Mr. Rosenzweig was an associate at Quinn Emanuel Urquhart & Sullivan, LLP.
Mr. Rosenzweig received his J.D. from Harvard Law School in 2005 and his B.A. in economics,
summa cum laude and Phi Beta Kappa, from the University of Pennsylvania in 2002.
Mr. Rosenzweig is admitted to practice in California and before the U.S. District Courts for the Central and Northern Districts of California and the U.S. Court of Appeals for the Ninth Circuit. He is a member of the American Bar Association Antitrust Division and the Los Angeles County Bar Association Litigation and Antitrust divisions.
