Whitney C. Ellerman is Head of the Washington, D.C. Litigation and Dispute Resolution Practice and Co-Head of that office’s White Collar Defense, Internal Investigations and Compliance Practice. Mr. Ellerman’s practice focuses on white collar criminal defense, internal investigations, and related civil and regulatory matters. He has represented Fortune 500 companies, high-ranking public officials and corporate executives throughout the nation in complex criminal cases involving alleged violations of the Foreign Corrupt Practice Act, and fraud, bribery, antitrust, anti-kickback, tax, securities, obstruction of justice and other criminal statutes. Mr. Ellerman also assists clients in designing, customizing and implementing comprehensive compliance programs.

Mr. Ellerman’s recent representations have included the following: 
  • Representing the acting CFO of a global manufacturer of engineered products in a wide-ranging FCPA case involving over 30 countries. 
  • Representing a number of current and former executives and employees of a government-sponsored enterprise in connection with SEC and DOJ investigations into the company’s accounting and reporting practices. 
  • Representing audit committees of boards of directors of major international corporations conducting internal investigations into whistleblower allegations and allegations of improper accounting practices, violations of the FCPA and other illegal activities. 
  • Serving as outside FCPA counsel to several Fortune 500 companies.

Mr. Ellerman served as an Assistant United States Attorney for the District of Columbia from 1996 through 2000. He is Chairman of the Advisory Committee on Admissions and Grievances for the United States Court of Appeals for the D.C. Circuit and the former Co-Chair of the ABA White Collar Crime Committee’s Subcommittee on Financial Institution Fraud/Money Laundering and Patriot Act. Mr. Ellerman is listed in the 2011 and 2012 editions of The Best Lawyers in America in the field of Criminal Defense: White-Collar.

Mr. Ellerman earned his Bachelor of Arts from the University of Virginia in 1983 and his Juris Doctor from the University of Virginia School of Law, where he was special projects editor of the Virginia Law Review, in 1988. He is admitted to practice in the District of Columbia and Virginia.
