Terra K. Atkinson concentrates her practice in residential mortgage banking matters, with an emphasis on issues unique to the wholesale and subprime lending industry. Ms. Atkinson’s clients include national and regional mortgage lenders, correspondent lenders, mortgage servicers, multi-state mortgage brokers and mortgage insurers. Ms. Atkinson has extensive experience counseling clients on issues related to compliance with federal and state regulations affecting the mortgage banking industry including the following: Real Estate Settlement Procedures Act (“RESPA”), Truth in Lending Act (“TILA”), Fair Credit Reporting Act (“FCRA”), Fair and Accurate Credit Transactions Act of 2003 (“FACTA”), Home Ownership and Equity Protection Act (“HOEPA”), Equal Credit Opportunity Act (“ECOA”), and Gramm-Leach-Bliley Act. Ms. Atkinson’s practice also focuses on loss mitigation efforts, including title insurance claims, breach of contract claims under broker and correspondent lender agreements, litigation involving mortgage elimination scams, and the handling and negotiation of borrower rescission claims and repurchase/indemnification claims under various secondary market agreements.
Prior to joining Katten, Ms. Atkinson practiced in the area of bankruptcy and restructuring law. Ms. Atkinson was included in Business North Carolina’s 2005 Legal Elite for Bankruptcy Law.
Ms. Atkinson earned her Honors Bachelor of Arts degree, magna cum laude, from Rollins College in 1999 and her Juris Doctor degree from the University of Virginia School of Law in 2002. She is admitted to practice in North Carolina. Ms. Atkinson is a member of the North Carolina and Mecklenburg County Bar Associations and is a founding member of the Charlotte Women’s Bar.
