"Tales From De-Crypt:" Movie Industry Wins A Round In DVD Copyright Protection Battle

The availability of entertainment content in digital form increases the risk of copyright infringement. A recent case brought by the movie industry may impact future litigation under the Digital Millennium Copyright Act. The case involved defendants who posted on the Internet a code that bypassed technological protection measures controlling access to copyrighted works.The court permanently enjoined the defendants from posting the code on any web site or trafficking it in any way, including links to other sites with the code. The decision includes potentially significant treatments of several issues:

- Linking to other sites
- The First Amendment
