Qualifications and Career Profile
Mr. Smith has over 40 years of experience litigating complex commercial and business matters of all kinds, including in the areas of securities, accountants’ liability, shareholder suits, real estate, environmental and product liability. In 1986, he successfully represented Transamerica Delaval (now known as Imo Industries, Inc.) in the Supreme Court of the United States in a case which established a significant product liability precedent. Mr. Smith represented the same client through two jury trials and appeals to the Second Circuit Court of Appeals in connection with the successful defense of product liability claims originally exceeding $800 million relating to the manufacture and operation of generators at the Shoreham nuclear power plant. He is listed as a New York Super Lawyer in New York Super Lawyers — Metro Edition (2006-2009) and has been listed repeatedly in The Best Lawyers in America in Commericial Litigation.

Mr. Smith is a member of the American Bar Association, New York State Bar Association, Association of the Bar of the City of New York, the Federal Bar Council, the New York County Lawyers’ Association, the American Arbitration Association (National Panel of Arbitrators) and the American Law Institute.
Education
Mr. Smith received his undergraduate degree (B.A., 1957) from Dartmouth College, Phi Beta Kappa, and his law degree (LL.B., 1960) from Harvard Law School.
