Partner Kathleen Moriarty Quoted on CNNMoney.com on Lehman Acquisition

September 16, 2008

Kathleen Moriarty, a partner in the firm’s Financial Services Practice, was quoted in an article on CNNMoney.com on Barclays PLC’s proposed acquisition of Lehman Brothers Holdings Inc., which would pose problems for Barclays exchange-traded funds business. More than a dozen Barclays’ iShares ETFs track Lehman indexes—a conflict of interest according to the Securities and Exchange Commission. Ms. Moriarty says, “You can't have a situation where the index provider could alter the index to suit the needs of the fund.” She adds that while Barclays may be able to get permission from the SEC, some legal work will be required.
