Mark C. Simon has more than 25 years’ experience representing a wide array of real estate clients, including foreign and domestic lending institutions, pension fund advisors, development companies and other real estate investors. He has considerable workout experience through three real estate market downturns.
His recent transactional work includes:

Representation of the agent banks on $5 billion unsecured credit line to publicly traded mall REIT.

Representation of real estate development company on sale of two hotels in 81-story tower under construction in Chicago.

Representation of construction lenders on $288 million financing of 50-story condominium tower in Sunny Isles Beach, Florida.

Representation of administrative agent on $550 million secured REIT credit line.

Representation of pension fund advisor on pre-construction purchase of $162 million office project in suburban Chicago.

Documentation of multi-tranched, senior/subordinate loan structures for office, apartment, senior living and land development projects.

Representation of institutional partner in joint venture to develop 40 warehouse properties in Illinois and Wisconsin.

Documenting numerous restructurings of syndicated loans.

Extensive sales and purchases of defaulted mortgage and mezzanine loans.

REO Sale Counsel to two major institutional lenders.

Negotiation and settlement of co-lender and intercreditor disputes.

Pro bono representation of La Casa Norte in developing a transitional housing shelter in Chicago’s Humboldt Park neighborhood.
Mr. Simon speaks and writes frequently at seminars on workouts and real estate finance. His 2009 engagements include writing an article and speaking on “Loan Sales and Syndications: Key Issues In a Troubled Time” for PLI’s Commercial Real Estate Financing 2009: How the World Changed.
He is listed as one of Chicago’s best real estate lawyers in Chambers USA: America’s Leading Lawyers for Business (2003–2011), Illinois Super Lawyers (2005–2012) and The Best Lawyers in America (2008–2012).
Mr. Simon earned his B.A, magna cum laude, from Carleton College in 1976 and his J.D., with honors, from the University of Michigan Law School in 1979. He is admitted to practice in Illinois.
