David Weisman concentrates his practice in white collar criminal litigation and insurance and health care fraud. He brings more than two decades of law enforcement and legal expertise to the firm, including a ten-year tenure as a federal prosecutor and four years of service as a special agent in the Federal Bureau of Investigation.
As an Assistant U.S. Attorney in the United States Attorney's Office for the Northern District of Illinois, Mr. Weisman represented the United States in federal criminal prosecutions relating to public corruption, complex fraud, street gang prosecutions and domestic terrorism. In this role, he was responsible for all aspects of litigation, including pre-indictment investigation, discovery issues, pre-trial litigation, trial and appellate issues. In addition, as senior litigation counsel, Mr. Weisman supervised trial assignment, preparation and execution of all criminal cases prosecuted by the U.S. Attorney’s Office. From 2005 to 2009, Mr. Weisman served as deputy chief of the General Crimes Section of the U.S. Attorney’s Office, where he supervised and trained newly appointed prosecutors in the handling and prosecution of criminal cases, and was responsible for the administration and coordination of several Department of Justice initiatives.
During his tenure with the U.S. Attorney’s Office, Mr. Weisman was honored with the Cook County Crime Prevention Excellence in Law Enforcement Award and twice received the Star of Distinction Award from the Chicago Crime Commission. He also received the Department of Justice Director’s Award for Superior Performance for his prosecution work in United States v. Matthew Hale.
Previously, Mr. Weisman served as assistant corporation counsel for the City of Chicago. He began his legal career as an associate with Glasser & Glasser, P.L.C. Before that, Mr. Weisman was a special agent with the Federal Bureau of Investigation.
Representative Experience
- United States v. Burge, 08 CR 846 (N.D. Ill.). Lead trial counsel in prosecution of retired Chicago Police Department commander convicted of lying about systematic torture and abuse of criminal defendants dating back to the 1970s and 1980s. Defendant convicted following month-long trial.
- United States v. Sriram, 482 F.3d 956 (7th Cir. 2007). Lead counsel at sentencing and successfully prosecuted appeal, reversing adverse decisions by district court in multimillion-dollar Medicare fraud case.
- United States v. Jung, 473 F.3d 837 (7th Cir. 2007). Trial counsel in fraudulent investment scheme committed by CBOE trader resulting in $26 million loss to investors.
- Operation Impunity. Street gang prosecution resulting in charges against 56 gang members on drug conspiracy and related charges. Led multi-agency investigation and served as trial counsel.
- United States v. Hale, 448 F.3d 971 (7th Cir. 2006). Lead counsel throughout prosecution, including appeal, of white supremacist who solicited murder of federal judge.
- United States v. Helmos Foods, 274 F.3d 1127 (7th Cir. 2001). Appellate counsel in prosecution of food distributor for the sale of tainted food products.
- Burdulinski v. City of Chicago, et al., 98 CV 5758. Trial counsel in excessive force/false arrest case, seeking damages in excess of $500,000. Obtained defense verdict.
- Carroll v. Haynes, et al., 97 CV 7486. Trial counsel in excessive force/false arrest case. Obtained defense verdict.
- Gonzalez v. City of Chicago, et al., 239 F.3d 939 (7th Cir. 2001). Counsel in district court proceedings. Obtained dismissal pursuant to Fed. R. Civ. P. 12(b)(6) in suit brought by Chicago Police Officer against supervising officers. Judgment affirmed on appeal.
- Ienco v. City of Chicago, et al., 148 F.Supp.2d 938 (N.D. Ill. 2001). Counsel in district court proceedings. Obtained summary judgment in wrongful arrest/malicious prosecution claim. Judgment subsequently affirmed on appeal. Ienco v. Angarone, 429 F.3d 680 (7th Cir. 2005).
Memberships and Affiliations
Mr. Weisman is a member of the Leadership Greater Chicago Leadership Fellows Association. He also is involved with the mock trial program at Chicago’s Lawndale School.
Education and Bar Admissions
Mr. Weisman received his Bachelor of Science in commerce, with distinction, from the University of Virginia in 1986, and his Juris Doctor, with honors, from the University of Texas in 1989. He is admitted to practice in Illinois and before the U.S. District Court for the Northern District of Illinois and the U.S. Court of Appeals for the Seventh Circuit.
