Kristin C. Wigness concentrates his practice on debt restructurings, loan workouts, secured and unsecured lending transactions, debtor-in-possession financing, creditors’ rights and insolvency.

Mr. Wigness has represented numerous agents and lenders in loan workouts and as debtor-in-possession lenders, including in the Chapter 11 cases of United Airlines, Tower Automotive, American Commercial Lines, Mariner Post-Acute Network, Polaroid Corporation, Burlington Industries, Guildford Mills and Sea Island Company. He has also represented various sellers and buyers of assets through bankruptcy, debtors, licensors and creditors. In addition, Mr. Wigness has assisted mortgage lenders in connection with sales of mortgage pools and in restructuring financing transactions of mortgage portfolios.

Mr. Wigness is a frequent speaker at seminars and universities, including the Bloomberg Bankruptcy Law Seminar "The Changing Dynamics of Bankruptcy – Peeking From Behind the Hedge and BAPCPA" and the University of Minnesota Law School Structured Finance Class. He is the author of "Trademark Licenses in Bankruptcy – Can You Assume or Not Assume, That is the Question," Bloomberg Bankruptcy Law Reporter.

Mr. Wigness earned his B.F.A. from the State University of New York at Purchase in 1987, his M.M. from the University of Michigan in 1989 and his J.D. from Rutgers University School of Law in 1994. He is admitted to practice in New York and New Jersey.

Recent Representative Matters Include:
  • Represented secured lender in connection with pre-arranged bankruptcy plan involving the sale of a major resort located in Georgia for a purchase price in excess of $300 million.
  • Represented secured lender in connection with debt and equity restructuring involving approximately $200 million loan facility for multiple casinos in Nevada.
  • Represented secured lender in connection with proposed restructuring and sale of debt involving approximately $700 million loan facility to major casino.
  • Represented secured lender in connection with restructuring of $150 million loan facility for instrument manufacturer.
  • Represented secured lender in connection with bankruptcy of automobile dealer and sale of assets and real estate through 363 sale process.
  • Represented mortgage lender and servicer in connection with workout of $1.2 billion structured loan arrangement relating to housing development mortgage loan portfolio.
