Katten Muchin Rosenman’s David Kistenbroker and Bruce Vanyo to Discuss Key Securities Litigation Issues at Upcoming Conferences

CHICAGO - Katten Muchin Rosenman LLP today announced that David H. Kistenbroker and Bruce G. Vanyo, co-chairs of the Firm’s National Securities Litigation Practice, will be featured as guest speakers on timely securities litigation issues at a number of upcoming high-profile conferences. Mr. Kistenbroker will participate in the following events:
  • 19th Annual Stowe Producer Conference, September 5-7, 2006, Stowe, Vt. – This conference, presented by the National Union Fire Insurance Company of Pittsburgh, Pa., will explore issues surrounding the complex legal, regulatory and liability nuances of operating in an increasingly global and borderless business environment. Mr. Kistenbroker will serve as a panelist for the event’s Securities Litigation Roundtable.
  • Securities Litigation and Enforcement Institute 2006, September 11-12, 2006, San Francisco – Presented by the Practising Law Institute, this conference will feature a faculty of leading practitioners, SEC officials, federal prosecutors and judges that will discuss the latest securities case law, enforcement initiatives, emerging trends and breaking developments.
    Mr. Kistenbroker will serve as a panelist in a session which will discuss the impact of the amendments to the Organizational Sentencing Guidelines. The topics that he will cover include limited situations in which an organization will need to waive its attorney-client privilege, and best practices and strategies for conducting internal investigations.
  • Stock Option Pricing Practices: What You Need to Know, September 19, 2006, New York – During this event, presented by the Practising Law Institute, Mr. Kistenbroker will discuss the latest developments in identifying and dealing with stock option pricing problems, including backdating, springloading and market timing. He will also explore the best practices to follow going forward.

Mr. Vanyo will also serve as a panelist at the Securities Litigation and Enforcement Institute 2006 conference, participating in a session on defending securities class actions. Topics that he will discuss include pleading motions; the handling of confidential witnesses; dealing with the problem on multiple fronts; preparing for trial, including Limine motions, Daubert motions and other pre-trial proceedings; and issues surrounding AOL/Time Warner.

David H. Kistenbroker

A highly successful securities litigator, Mr. Kistenbroker has achieved complete victory in more than half of his cases since 1997, many of which helped to shape today’s securities laws. His practice is focused on the representation of publicly traded companies and their directors and officers in securities class actions, SEC investigations, and corporate governance disputes. Among the major companies that Mr. Kistenbroker has defended in securities cases over the last five years are: The Boeing Company, Cerner Corporation, CBIZ Inc., K-Mart and Keithley Instruments Inc.

Bruce G. Vanyo

Mr. Vanyo has practiced in the area of securities litigation for more than 30 years and has defended more than 200 major securities cases in 20 states. His practice includes the defense of securities class actions, defense of derivative litigation, representation before the SEC and representation of board committees in conducting internal investigations. Mr. Vanyo also provides counseling in corporate governance matters.

Although many of Mr. Vanyo’s clients have been technology companies, he has also served clients from such diverse industries as life sciences, airlines, motion pictures, banking, and insurance. His clients have included: Krispy Kreme Doughnuts, Dell Computer Corporation, The Boeing Company, Fluor Corporation, America West Airlines, Amdocs Limited, Sun Microsystems, Inc. and Genentech, Inc.

Mr. Vanyo has been highly successful in winning cases. In the last five years, he has achieved complete victory in 21 cases, including seven appellate victories in five different federal courts of appeal. Over his career, he has pioneered much of the securities law that has been favorable to defendants. In recognition of his experience in this area, he was asked by the technology industry to help lead its effort to accomplish securities litigation reform and, subsequently, by Congress to draft the pleading and safe harbor provisions of the Private Securities Litigation Reform Act of 1995.
