JCAHO “Clarifies” Position On Bylaw Amendments

The JCAHO recently issued a "Correction" and "Clarification" to MS.1.20 of the Accreditation Standards for Hospitals.  In a recent audio conference in which it addressed MS.1.20 and EP 19, the JCAHO affirmed its position that they do not dictate how the bylaws are to be amended and therefore, the Clarification has no impact on the continued ability of hospitals and medical staffs to adopt either a single or different standards for amending various bylaw provisions. For example, the hearing portion of the bylaws could be amended by the Medical Executive Committee with final approval by the Board, whereas the remaining portions could follow the more traditional approach of requiring approval by the Medical Staff as well.
