Craig M. Kuchii concentrates his practice in intellectual property matters, with an emphasis on patent, copyright, trademark, trade dress and trade secret litigation.

As a registered patent attorney, Mr. Kuchii has a broad range of experience in intellectual property law. He assists clients in assessing the value of their intellectual property by providing clearance and infringement opinions. He also helps clients tailor their business strategies, with the twin goals of providing strong protection for their unique ideas and using those ideas to further the growth of their business.

In particular, Mr. Kuchii has been active in the area of pharmaceutical patent litigation. He has experience with legal issues relating to ANDA litigations, especially Hatch-Waxman exclusivity periods, the FDA approval process, and settlements involving antitrust concerns.

Mr. Kuchii has been involved in cases including:

Pfizer v. Apotex, Inc., 480 F.3d 1348 (Fed. Cir. 2007), in which Apotex entered the market after successfully invalidating the patent on Pfizer’s billion-dollar drug Norvasc.

Daiichi SankyoCo. v. Apotex, Inc., 501 F.3d 1254 (Fed. Cir. 2007), in which Apotex entered the market after successfully invalidating the patent on Daiichi’s antibiotic ear medication ofloxacin. After the appellate decision, Apotex further recovered $5 million in damages for a wrongful injunction that had been entered by the district court.

Mr. Kuchii earned his Bachelor of Science degree in biology, cum laude, from Tulane University in 1994. He was founder and president of the Asian American Students United and a member of the Executive Committee of Student Affairs of the Asian Pacific American Society. He was also a member of the Randall Gibson Honor Society and a Tulane Honors Scholar. In 2004, Mr. Kuchii earned his Juris Doctor degree from Northwestern University School of Law, where he served as founder and managing editor of the Northwestern Journal of Technology and Intellectual Property. He was awarded the Law Alumni Scholarship and was a member of the Intellectual Property Society, Asian Pacific American Law Students, Phi Delta Phi and the Registrar Committee.

Mr. Kuchii is admitted to practice in Illinois and before the U.S. District Court, Northern District of Illinois. He is proficient in spoken Japanese.
