Representative actions:
  • Obtained dismissal on behalf of former CFO and Controller of Kmart Corporation in consolidated securities class action asserting violations of Sections 10(b) and 20(a) of the Exchange Act, which arose out of Kmart's bankruptcy and claimed these officers committed financial fraud. Defended these former officers on appeal to Sixth Circuit which affirmed the dismissal.
  • Represented Acceptance Insurance Corporation in consolidated securities class actions arising under Sections 10(b) and 20(a) of the Exchange Act. Obtained summary judgment on client's behalf and persuaded district court to sanction Milberg Weiss for discovery violations, obtaining for client the recovery of significant costs and fees incurred as a result of Milberg's misconduct.
