Brian Sodikoff concentrates his practice in intellectual property matters with significant experience in patent, trademark, copyright, and trade secret practice. Recently, Mr. Sodikoff’s practice has focused on complex patent litigations. He has worked on all phases of cases involving a diverse array of technologies, including thermoplastic air bag covers, automated truck transmissions, DVD technology, and hard disk drives.
Mr. Sodikoff has particular experience in patent litigation matters involving the pharmaceutical industry. Through that experience, Mr. Sodikoff has developed a strong understanding of the legal issues surrounding ANDA litigations, including the intricacies of FDA approval, exclusivity periods under Hatch-Waxman, and the antitrust implications stemming from settlements. Mr. Sodikoff was involved with two lead cases in the pharmaceutical field:
Pfizer v. Apotex, Inc., 480 F.3d 1348 (Fed. Cir. 2007). In that case, Apotex entered the market after successfully invalidating the patent on Pfizer’s billion dollar drug Norvasc.
Daiichi Sankyo Co. v. Apotex, Inc., 501 F.3d 1254 (Fed. Cir. 2007). In that case, Apotex entered the market after successfully invalidating the patent on Daiichi’s antibiotic ear medication ofloxacin. After the appellate decision, Apotex further recovered $5,000,000 in damages for a wrongful injunction that had been entered by the district court.
Previously an associate at an intellectual property boutique firm, Mr. Sodikoff has experience in all phases of intellectual property law. A registered patent attorney, Mr. Sodikoff has prosecuted and secured patents for a wide range of technologies. In this role, Mr. Sodikoff partners with clients to design and implement customized strategies to create strong patent protection that transform ideas into competitive business advantages. Mr. Sodikoff has also worked with clients to develop brands through trademark prosecution and protect proprietary information through trade secret protection.
Mr. Sodikoff received his Bachelor of Science degree from Vanderbilt University in 1999, where he concentrated on neuroscience and defended an honors thesis on the medial geniculate complex in monkeys. He received his Juris Doctor degree from DePaul University School of Law in 2003, where he was a member of the Law Review and graduated summa cum laude. He is admitted to practice in Illinois, the Northern District of Illinois, the Federal Circuit, and is a registered attorney at the U.S. Patent and Trademark Office. He is a member of the American Bar Association and the Chicago Bar Association.
