Ariel M. Dybner, a partner in Katten Muchin Rosenman LLP’s New York office, concentrates his practice in the areas of real estate, real estate finance and the workout of troubled loans.

Mr. Dybner has represented institutional lenders, banks, investment banks, insurance companies and finance companies in connection with billions of dollars in financings and workouts. He has represented landowners, developers and equity investors in developments throughout the United States and the Caribbean. He has also represented Fortune 500 companies in leases of office space, and in the real estate aspects of mergers and acquisitions transactions.

Recent activities include:
  • Advised financial company as to billions of dollars in workouts of real estate loans for projects in New York, New Jersey, Massachusetts and Pennsylvania.
  • Advised foreign bank as to real estate issues on the workouts of over $2 billion in loans for five Nevada casinos, including one casino on the Strip, three others in Clark County and one in Nye County.
  • Advised purchaser of discounted junior/mezzanine loans for hotel projects in Boston, MA; Aspen, CO; Austin, TX; Grand Prairie, TX; Houston, TX; and San Antonio, TX; and office projects in New York and Santa Monica, CA.
  • Advised with equity structuring for 500-key hotel in Times Square and new museum/condominium project on Fifth Avenue.
  • Advised German banks on the acquisition of loans for a California office portfolio, a Chicago office portfolio and a GSA-leased office building in Washington, D.C.
  • Advised construction lender as to over $2 billion in construction loans for development projects throughout the United States.
  • Advised investment bank and developer on Rule 144A construction financing project for resort/golf/hotel project in the Dominican Republic.
  • Advised on foreclosures and deeds-in-lieu of foreclosure in Chemung, Nassau, New York, Sullivan and Ulster Counties in New York; Bergen County, New Jersey; and Philadelphia County, Pennsylvania.
  • Advised Fortune Global 100 company on the real estate aspects of the acquisition of a large baby products company and the disposition of headquarters-style office building in Westchester County, New York.
  • Advised client on a lease to a Fortune 500 company for its headquarters in Connecticut.
  • Advised lending client on over $100 million in Shari’ah compliant loans for condominium projects in Massachusetts and New York.

Education and Bar Admissions

Mr. Dybner graduated from Amherst College with a Bachelor of Arts in Political Science in 1990. He received a Master of Science in Foreign Service in 1992 from Georgetown University. While at Georgetown, he received the Dean's Award for Academic Excellence. In 1997, Mr. Dybner earned his Juris Doctor degree from Columbia Law School. While at Columbia, he was a Harlan Fiske Stone Scholar and served as an articles editor on the Columbia Business Law Review.

Mr. Dybner is fluent in Spanish and is admitted to practice in New York. He is a member of the Hispanic National Bar Association.
